You need to see a vet as soon as you can. There are problems in the environment that need to be corrected, but this animal sounds ill enough to need medical help beyond simple changes in its home.
It sounds like your pet does not have access to proper heat and light. Find out the specific requirements for the type of tortoise you have and be sure you have a proper set-up when it comes home.

I'm sorry your Tortoise sounds very sick, call a vet your local Reptile store, or the Turtle/Tortoise Rescue office in your area for help...theres nothing anyone else can do without knowing what made him so sick..Good Luck
